Jed continues, “Over the past week, I have studied the Oregon Constitution and some of the relevant statutes, and conferring with an attorney concerning my learnings via email. Friday evening, I had a lengthly conversation with the attorney, confirming what I’ve been suggesting. From my understanding, here’s how the law applies regarding the Oregon Governor’s Executive Orders and emergency powers.

The Oregon Constitution and statutory law give the governor broad powers under an emergency declaration. The Governor’s Executive Orders have not necessarily been unconstitutional concerning their intent and restrictions, especially considering precedence set by case law. But there’s more…

The Governor declared an emergency through Executive Order 20-03 (https://www.oregon.gov/gov/Documents/executive_orders/eo_20-03.pdf) on March 8, 2020, invoking her full emergency powers. The executive order states that the “emergency shall exist for sixty days” from that date. However, the Oregon Constitution Article 10-A Section 6 limits the length of time the Governor is allowed to have such broad emergency powers.

“Section 6. Termination of operation of this Article; extension by Legislative Assembly; transition provisions; limitation on power of Governor to invoke this Article.
(1) Except as provided in subsection(2) of this section, the provisions of sections 1 to 5 of this Article, once invoked, shall cease to be operative not later than 30 days following the date the Governor invoked the provisions of sections 1 to 5 of this Article, or on an earlier date recommended by the Governor and determined by the Legislative Assembly. The Governor may not recommend a date under this subsection unless the Governor finds and declares that the immediate response to the catastrophic disaster has ended.

(2) Prior to expiration of the 30-day limit established in subsection (1) of this section, the Legislative Assembly may extend the operation of sections 1 to 5 of this Article beyond the 30-day limit upon the approval of three-fifths of the members of each house who are able to attend a session described insubsection (3) of section 3 of this Article.” (https://sos.oregon.gov/blue-book/Documents/oregon-constitution.pdf)

I recommend reading all of Article 10-A for yourself, but to summarize the portion above, the Governor’s emergency powers are limited to a maximum of 30 days, unless the Legislative Assembly is convened prior to the expiration of that 30-day period and votes to extend those powers beyond 30 days. This is to protect the people from extended infringment of rights and limit the potential abuse of emergency powers. It requires these broad emergency powers to be temporary.

The 30-day clock started on March 8, 2020, with the declaration of emergency by Executive Order 20-03. All of the other Executive Orders concerning this emergency were under the authorization of emergency powers invoked by that first order. Therefore, these emergency powers, and all executive orders regarding this emergency, became null and void by April 7, 30 days from when she invoked the emergency powers, despite some of the orders having a stated effective period longer than 30 days. The Governor failed to convene the Legislative Assembly before April 7 to extend these powers beyond 30 days, rendering these orders unenforceable at this point. They most likely would not withstand judicial scrutiny.

This means our liberties are restored by the Oregon Constitution already as of April 7. We are free to gather for work, for education, for worship, to open our businesses, to peaceably assemble, and to petition our government for redress of grievances. While potentially bluffed in our ignorance, legally, under the Oregon Constitution, we cannot be cited or arrested for returning to our normal lives at this point. And if we are, we have legal grounds to challenge such action in court, and there are teams of attorneys aware of this and ready to defend against such action. Please note that I am not a legal expert and this should not be considered legal advice. I am sharing my best research and understanding based on my reading and discussion with an attorney. You assume the risk of any actions you take based on this information.

In conclusion, use precaution, and respect other’s rights and wishes to remain at home or in a protective environment, maintain physical distance, or keep their business closed. I know almost 25 people who have had, or likely had, this virus, and it is an ugly sickness. I don’t want to get it, and I don’t want anyone to get it. So I will be careful even though I believe the risk is drastically reduced now, and I will also avoid contact with higher risk people as much as possible. However, I will also resume some normalcy, gather in worship when our church opens, and do my part to help our economy recover. I hope to grow my business back and beyond the levels we were at prior to this virus. And I hope you will join me, respecting our fellow citizens, and proceeding with caution and responsible liberty as we return to work and some normalcy.”

My name is James Carner. I live in Bend, OR with my wife and disabled son. I own several businesses and am almost at the point of moving my company business license and taxes to another state to avoid the draconian powers of the left’s grip on Oregon. I also am an assistant pastor and worship leader for a small church.
 
After a brush with death from drinking booze 15 years ago, I got sober. With a clear head, I decided to try and figure out the meaning of life. I was bold enough at that time to try and put everything down within 5 paragraphs. Needless to say, the big picture I had written down changed every day after reading a new book or watching some YouTube documentary.
 
For years I have been researching things from religion to economics to warfare and/or history, but the more I dig deep down this rabbit hole, the more confused I got. There is something missing. Something that is not being told to us and being held back by our leaders. And what is not being told to us, is the substance of freedom and how to obtain it.
 
What is freedom? It’s a worldwide material right to do whatever we want within reason and without malice. The idea to travel and meet cultures to learn something we’ve never know before. A way to open up our pineal gland that gives us peace and connects us to worlds unseen. And unfortunately, there is a small group of people that want to destroy it.
 
I can give you my personal opinion on what is going on around the world and where I see things in 20 years. I can tell you with great confidence as to what to believe by using this media platform and my own biased point of view. However, that wouldn’t really solve anything. Opinions are not facts and facts are at most times, biased opinions. Especially in this age of fake news, which by the way, ever since the invention of the printing press, people have printed lies.
 
So I decided to make a change. I started Take Oregon Back. It’s a media source that reports what I and my authors see from a freedom perspective. There are many forms of control and history has shown there are groups who want to control it all. I have learned that you cannot make a change with posting your opinion, however, action can bring about change.
 
I plan on covering protests and create protests. I see two problems in the State of Oregon right now. Number one is an unconstitutional lock down power grab and number two is a mail in voting fraud scam that will harm November’s presidential election. These are the two most important things that need addressed this year and I hope you stand with me as I continue to report, organize and stand up to our socialized leaders.

Our founding fathers knew that absolute power corrupts absolutely. They understood from history that every regime of power goes beyond its limitations. Why? Because it’s human nature. Give any child a toy and the child beside it will want it. It’s in our DNA. But why a militia? Don’t we have a military and a national guard? A backup needs a backup. That’s what is so brilliant about the Constitution. It was written to be the best of the best. And it has withstood for over 200 years now.

A militia is needed to be armed and ready at a moments notice. Always alerting the state that if the justice department becomes corrupt, it will be triggered. Always alerting the governor that if they go against the people for personal gain, the militia will be activated. It gives the power of fear from all directions to make sure that our leaders are held accountable for their actions. A militia is the last defense that people have in order to restore it’s original constitution. It’s a group of ex-military, ex-national guard and volunteers that the state appoints.

Every state is required to have one. Article 10 (X) of Oregon’s Constitution, and you can view it here, says, “Section 1. State militia. The Legislative Assembly shall provide by law for the organization, maintenance and discipline of a state militia for the defense and protection of the State … The Governor, in his[her] capacity as Commander-in-Chief of the military forces of the State, shall appoint and commission an Adjutant General. All other officers of the militia of the State shall be appointed and commissioned by the Governor upon the recommendation of the Adjutant General.”

If you Google the term “militia”, you will see all kinds of good resources that explain the purposes of having a fighting organization of non-professional soldiers called upon for military service for times of need. It will show links explaining a militia is, “a body of citizens enrolled for military service, and called out periodically for drill but serving full time only in emergencies”. There is nothing sinister about it. There is nothing scary about it. Yet, our own state does not have one. Why?

In 2016, Robert LaVoy Finicum, a spokesman for the militia group “Citizens for Constitutional Freedom”, seized and occupied the Malheur National Wildlife Refuge in the State of Oregon in protest to the terms of his grazing permit with the Bureau of Land Management (BLM). His family had a legal right to graze there while the government (Clinton Foundation) had sold the rights to the Uranium resources where the cows grazed to Russia.

The media, and even Wikipedia,  back in 2016, during this intense standoff, painted a picture that Finicum was a thief. They used the word “militia” as a group of thugs and demonized them standing up for their rights. In the end, the Bundy brothers were found not guilty of conspiracy in the Oregon militia standoff, however, not one elected official took responsibility for the death of Robert LaVoy Finicum by the hands of the FBI. Governor Kate Brown gave the order.

Trump on inauguration threatened the powers that be by stating he will give freedom back to the people. Freedom isn’t free.

The powers that be opened up an investigation the very first day Trump started. They failed. Then came impeachment. They failed. Then what are the odds that a virus less potent than H1N1, which Obama did nothing about wreck the economy so bad that the stock market went right back to its original state in 2016. No coincidence.

Folks, we have a chance to get our country back from a power that has raped our resources and profit since 1913. Trump just made the Federal Reserve to take orders from the Treasury.

What does that mean? It’s means that the 13 families that control the federal reserve (think Rockefeller’s, Rothchilds) have to obey Trump – he’s the new CEO of America, Inc. Is this true?

Why else would Trump be signing the treasury checks? Really smart people balk at this idea. They say the federal reserve has all the power. But this has changed. Through the EFM, Trump closed the back door to the bankers (think usery).

America, Inc grossed more than 1 trillion dollars a year in profit from Americans paying interest on our debt through bank loans from the federal reserve and from income tax. This 1 trillion a year will stop and in turn be directed into the treasury.

The 13 families that own 70% of all Earth have been cut off from America and Trump is bankrupting the federal reserve (think adding 1 trillion a day into the economy) and the federal reserve banks can’t do a think about it.

The federal reserve during a bankruptcy, which the 13 families will call for, will open up an investigation into the federal reserve where the DOJ will prosecute for the first time in history the fraud of “fractional reserve lending” from these vampires.

Everything that is happening which is crushing America, Inc must happen in order for us to freeze the accounts of the 13 families. A massive lawsuit worldwide will be placed in the name of crimes against humanity as the 13 families will be on trial for fraud, but most importantly, and here is the key, for human trafficking.

Legally no one could touch them. But Trump did this legally by going after their perversion. Drugs, pedophelia, and the like are being swarmed by our military gathering evidence during this crisis which the 13 families bestowed upon us just to make sure 45 doesn’t get re-elected.

You see, Trump played stupid. He played the media like he was a jackass while tweeting weird things and using his bafoon act to distract the media while he passes executive orders to indict the swamp.

There are over 150,000 sealed indictments in the US which in average we normally have 10,000. The rats are running (think CEO’s stepping down) and cannot fly out of America while we suffer through this economic downturn.

These hard times will challenge us. It will help grow our dependency on ourselves. Our own food. Our own supplies. Our own ideas and thoughts will spawn new innovations and inventions while we, during this draconian lockdown) will learn how to survive during hard times.

It’s no conspiracy. We’ve been warning you since the 80’s when Reagan was President. People like Bill Cooper and Ted Gunderson most their lives trying to expose the cabal that has been robbing us of our freedom.

“My people parish from lack of knowledge.” Hosea 4. This can never be so important in times like this. We must understand that the owners are crumbling right under our feet and stand up for our constitutional and bill of rights to say “NO!” to the controllers whom have used the media (whom are all owned by 6 companies – think monopoly) and stand up to the corruption.

If we allow them to beat us through brainwashing and indoctrination (think operation mockingbird) then we will lose. Our President needs our prayers and we as a nation must stand behind him and his plan to regain our liberties.

Now is the time. Now is the time to research and stand up to people who mock us. Who laugh at us. Who thinks everything is ok. Because it’s not. We have one last chance to get our country back and we can do it together?

How? We assemble. We talk. We elect leaders and study our enemies. We gather intel and resources that require our movement to grow. We do heavy vetting and do not let anyone in that does not pass the test or background check. We pull our resources and figure out how to use them wisely while also figuring out how we can make it grow with interest. We become a militia which our founding g fathers intended is to have if a tyrannical government takes control, which it has!

Trump can only do so much. It’s our governors that will get in the way of our freedom. We must single hand-idly remove them from office and elect leaders of our choosing. We educate our children and teach then to trust no government for any government that is working for themselves and not the people is an enemy.

We stand with a bullhorn and a gun. We make our leaders fear us as we need to teach them we will fight to get our freedom back. We do not give up. Be intimidated. Be let down and most certainly let our feelings get in the way of our children’s children’s future.

If not, we will be socialized then communized. It’s real. It’s time. This plannedemic should have taught us that we are not in control and our elected officials are on notice.

Protesting will not work. A million man march on Washington does not work. What works is starting with hour county and then to your state.

I have started a website called takeoregonback .com and it’s a media website tool to report on events going on in our counties. I need help. I need writers and bloggers and thinkers whom have ideas and balls to research and report.

I know you’re scared. I am too. But we will never be free again if we let the 13 families continue their reign over America. Pray for me. Enlist with me. Help me take the state of Oregon back from a tyrannical government!
